Bare with me people, its quite a long story but I was wondering if anyone could offer any advice.
I sold a selection of computer equipment on gumtree and there was far too much to list, various items of computer equipment, hard drives, monitors, TFTs that kind of thing.
I posted up a ad on Gumtree Nottingham 'Various computer Equipment MUST GO TODAY - sorry havent got the reference to hand
A chap came round, and after some conversation about the kit and after I'd shown the computer working etc, he made an offer to collect it all. He left a deposit, I gave him a few items for security and prepared it all in boxes etc
He came round when he said he would, and I helped him to his car with many boxes and the deal was done.
At this point, I had a funny feeling about the guy, he seemed hesitant, unsure, it made me feel uncomfortable, but I proceeded anyhow.
I wrote him a receipt, signed it, with my phone number, saying goods sold as seen, no refunds'
A few hours later, quite late at night actually, he called to say there was no power cables, I advised him that kettle leads are something one takes for granted that everyone has in their home but either way, invited him round that night, to come and collect the cables.
He left, said thanks and that he was happy. At this point, I used the opportunity to ensure he was, and I asked him "are you, becuase you seem hesitant, and now is the time to say before you leave" but he was happy enough and I thought that was the end of it.
A day later he called and said he wasnt happy, he didnt know where to plug in the monitors, he said one of the PCs didnt work (although I know he dropped one as he was taking it out to his car) and wanted either working PCs or his money back.
I am a fair guy, but wanted to stand my ground at some point, as I was going to London the next day permanentley, (hence the sale) and didnt have a lot of time. So I waited around until literally just before my train left, but he never got back to me, when I offered him to bring it all back.
A day later he calls again and says he's still not happy, I said, why dont I BACS you a £50 good will payment (he'd already bartered £20 of the asking price at the door) and we draw a line under it. He agreed, and I BACS him the £50 and went to London.
A day later he called again saying he'd sold all the equipment, and now THAT person wasnt happy and wanted his money back, and gave me his telephone number and post code.
Obviously at this point, im in London, miles away, several boxes of computer equipment at some random address in Nottingham which Im not going to get back and a guy I dont know.
Plus, the address is in not the best area, in a high rise block of flats so that triggers alarm bells.
The orignal buyers claim is that he wasnt getting what he paid for including exact spec of various PCs, and thus wasnt happy.
I have crossed referenced his complaint against my ad and it seems I was spot on, I was very honest, some of the kit Id not used in a while, and gave him a rough spec (nothing specific) and assured him he would need to just power it all up and investigate.
I am now left with a BACs payment Ive already paid the original buyer, plus some guy Ive never met (im still waiting for his phone number and full address from the orginal buyer (im not sure what there relationship is) to arrange a refund.
Should I refund?
What should I do?
Im a good guy, I dont want anyone to be unhappy, but I feel im stuck in the middle here, and not really sure what to do? |

if he isnt happy tell him to go and see citizens advice

FAO Buyer in Question (name hidden to protect privacy)
Taking into account my informal statement of events as described
above in a previous post, and in direct response to your threats over
the last 48 hours I would like to use Gumtree's forums as a medium to
position myself against you, prior to any civil and/or legal action inter-alia.
I note that Gumtree is not a valid forum for this type of dispute,
however, I feel with the agreement of the Gumtree community, and considering
you have given me no other way of contacting you other than phone, I
am left with this choice only.
Your threat by SMS late at night recentley, along with all other communications
you have made to me, are inconsistent, incorrect and injust.
Your claim that you have been mis sold equipment based on innacurate
descriptions is completley unfound. You have clearly been sold a range
of working and reasonably specified equipment as per my orginal advert
which is still posted on this website.
You have incorrectly assumed and attempted to enforce standard business terms
and conditions which do not exist during a private sale. Despite being given a
receipt very clearly stating you would not be given a refund.
You have harassed late at night via SMS and communicated incorrectly a range
of stories and events from selling these goods on, and your wish for me to refund
a third party, to offering to allow me collection of the goods, but never
offering a collection address.
Despite this, and my completely correct legal stature, I have offered to accomdate
various solutions for you including a part refund, which you initially agreed to
and changed your mind after, to a conditional refund based on me receiving the
entire inventory you were sold, and yet despite these attempts at resolution on
my part, you have been difficult. Refusing to supply contact information, and
refusing to answer calls.
I have considerable legal backing, and will not hesitate to use the facilities
available to me, to persue this further.
In summary, I feel I have been more than accomdating and this post is not to invite
you to respond, it is an offer for you to contact me in a more suitable manner, consider
your options and for us to reach an ammicable resolution.
This will be my last attempt to resolve this for you.

*** SITUATION UPDATE ***
I thought I may post updates on here, as things have happened since. Things went quiet from the chap for a while, he now gets in touch by mobile SMS, tellling me he's reported me to fraud becuase I have his account number and sort code (to pay in his refund) and that he's notified the police.
He also says he has passed the 'debt' on , for someone else to 'deal' with me!
Ive phoned the police, and logged the incident, I think this has put me of selling on Gumtree lol

Tell him to whistle. It's all bullshit. Threats of legal action is something I always do to get what I want. It's usually a lie.  |
