I have a n ex landlord who is chasing me for £k rent arrears , today he caught up with me and i have explained i am willing to sort out the arrears and come to a decent agreement with him .
I left his property at the end of august and i gave him notice.
He rang me today and threatned that if i havent paid the whole £3k into his bank account by the end of close of business tom then he will write to the following people ,
My employers
My bank
My family
My new landlord
Any company that i do buisness with
My neigbours
The church i go to
The police
The council
My mobile phone contract
in fact any person i have contact with in my daily life.
I am holding my hands up and saying yes i owe this and ye sim willing to pay these arrears, i have after paying out all bills £197 left to buy food , clothe myself and my wife who isnt working . I am scared witless that he can do this .
Please could i have some advice, and before anyone says it yes i know i have bought this on myself but i dont deserve these threats , he also says he got my new address from the state agent who used to be the managing agent for this property , is ther something i can do about that ? |

You don't deserve what exactly ???
He is not threatening you with violence.
Does he deserve to be out of pocket by £3000 ???
You say that you have rented a new place .... Rent up front + a deposit + fees ..... It sounds to me as you could have paid him his £3000, so why did you leave ???

Very strange that they would entertain the idea of doing business with you again !!!!

Thank you both for your kind replies, i know i have bought this on myself and i have not rented form an agency and neither have i tired to get out of not paying him what i owe , .
I am more than willing to pay and i am sorry you feel i am a troll thank you for that kind remark colin , you dont know me or my circumstances .
ALL I WANTED WAS ADVICE ON CAN HE SEND LETTERS THAT HE HAS THREATNED TO SEND TO PEOPLE SAYING I OWE THIS MONEY .
I AM MORE THAN WILLING TO PAY WHAT I OWE |

Maybe not a troll ... But shame on the agents for doing business with them.
I got took for £1200 earlier this you due to HB being paid late. They paid it to the tenant who then did a bunk with the cash.
I would like to know if this person is also on HB or some other form of benefit ...
Why would an agent rent to someone who only ends up with £197 for food per month ( or maybe thats per week !!! )

How did his 'Agent' get your new address if you are not using an Agent ?
You will have to forgive me for assuming you are a troll ( there are quite a few on here you know )

Thank you for your reply.
Let me explain a bit then maybe you will see.
I didnt use an agent to find my new property , i left my ex ll's property because the rent had got very expensive and i couldnt afford it , i had lost my job and we struggled to make ends meet . So moved to a smaller and cheaper property. My ex LL is a private LL he doesnt use an agent , he advertises in various places. My new LL is a private LL he also doesnt use agncies anymore after he got ripped off badly by one. The agent who gave my exLL my new address is the old agency my new LL used .
The deposit and rent upfront was paid for by company who specialises in helping with people who havent got the deposit and rent up front , so no money has changed hands via me . So deposit held will go back to these people , i had nothing to do with deposits etc .
I, as i have said just want to clear this nightmare up , i have held my hands up and admitte im wrong and i am wiling to come to an arrangement with my ex LL . I am just concerened with his threats of sending letters to people i know saying i owe this money surely he cant approach employers , the bank and various othr people and do this can he , thats all i wanted to know |

Contact Consumer Direct or Shelter.
The dispute is solely between you and the agent/landlord and they should not bring other parties into it. I believe people have been forced to pay compensation to tenants who have dragged in other unrelated parties into their disputes.
Having said that, if you are taken to court and a judgement is made against you for the debt and you fail to pay it, the claimant can arrange an 'attachment of earnings' which forces the employer to pay them directly out of your wages.
Therefore, in some circumstances, an employer will find out but only as part of a legal process to enforce payment.
Tenant tracing - the process of a party owed money finding the address of the party that has the debt - is legitimate and it is easy and legal to employ tracing agents. As to whether the party who forwarded your new address broke the data protection act, this is something that CAB or Consumer Direct can let you know.
Debts don't just go away when a person tries to hide themselves away. |

Why not? Of course he can. But they can only serve to embarass you as the recipients would not be able to hold the paper on your record since it is just hearsay and they would ignore it as there is no proof behind the allegation and possibly has nothing to do with them.
He will however achieve recognition of this when he goes to court and get a CCJ against you as this is then available to all that look at credit rating as yours will be damaged and you will find it very hard financially to do anything.
You will also have to pay court fees and his expenses together with interest on the amount owed from the date owed to payment date at a rate of 8% pa. So you need to agree a payment plan with him before it is too late.
He should give you a reasonable amount of time to pay the debt and the fact that he is using threats mean that you may have left it too long to negotitiate repayment with him. |
