NIGHTMARE LANDLORD! PLEASE HELP

Hi everyone! I need some advice! Im an ex student who lived in a student house! there were 4 of us all together, one Dutch 3 English, anyway when teh Dutch girl moved out last week the landlady and landlord came round to quicky check the house and give ehr back her deposit-there was nothing wrong with the house so she received the full deposit back. when i text her the following week to arrange to meet her to give back keys and get deposit back she was being really awkward. anyway... later that day i recived a call from my friend to say my landlady had been on the phone to him, as she had found cv's with his name on and our address. He wasn't a tennant, he was only staying there the occasional night as he was looking for a job and needed somewhere to stay and used out address as a care-over address-just somewhere in liverpool to get his mail sent. she thinks he has been living there and now refuses to give us back out deposit unless he pays her rent-however he never stayed more than 2 or 3 nights and has pay slips from back home where he has another job which proves he never stayed there for a long period of time. she keeps callign him demanding money, he has explained the situation but she won't listen. I just wondered if anyone knows where we stand with all of this, she can't prove he stayed tehre,a nd has no dates etc. however, are we going to get into trouble for using her address for his post to be sent to?? she is being a total nightmare and is threstening to take legal action! i don't know where we stand in all of this, if anyone can help id be extremely grateful. cheers

Question Katie plz email me on giondomenicoroz@aol.com I am a bit confused as to the exact events you outlined however you do have certain legal rights. As an agent I am often taking tenants to court for non payment of rent, and am very much 'up' on tenant/landlord issues. Some of the questions I have are did you all leave the property. When did you originally move in as if it was after 6th April 2007, there is new legislation protecting your deposit. also unless you have it in your contract (tenancy agreement) that the landlord can charge you extra, on what basis are they making these claims?

Your 1st step needs to be to collect information from different sources. Go to the CAB (Citizens Advice Bureau) and to your free Legal Advice Centre ... try to talk to a solicitor who is free and they should give you advice on what you need to do and if you need to take a solicitor or not. Don't be intimidated by the landlady, that is the problem that most tenants have (including myself) ... but this is how they normally win and get money from you unlawfully.

Speaking as a Landlady, I have to tell you that "Allowing friends to stay for a few nights and use the address" can cause ENORMOUS problems for the owner of the property with the local Council.
Example: I had 4 tenants in my 4-bedroomed property in Edinburgh and there was a fire in the stair. (Caused by students who'd just moved nto a flat lower down falling into a drunken sleep and leaving candles burning. One of them - a German guy - died!)
My tenants had to be removed from my property via the front windows by the Fire Brigade.
Next thing I know, an Environmental Officer from the Council wants to see me. He informs me that the Fire Brigade rescued 7 people from my flat (it all happened over a weekend and my tenants had boy/girlfriends staying over).
According to him, I was obliged to install a second bathroom - or a wash-hand basin in every bedroom and an additional loo elsewhere. He was having nothing to do with the fact that I only had 4 tenants! I was not receiving a penny off of any of the other 3 people who were there at the time of the fire.
Can you now see it from the owner's point of view?

Question Question Are you based in scotland and if so there may be different laws covering rentals. With regards to the sad events you outline, you say a fire from a flat below. Is the property classed as one as a household under multiple occupation??

In England as from April 2006 all properties with three or more habitable floors and if it is let to five or more people from seperate households, i.e. 5 students, then this would now fall under the new and updated HMO regulations and would need a licence from the local authority to permit letting. The penalties can be quite severe for not adhering to this new piece of legislation.
