This is a true story with Blackburn brothers an Cricketfield service station in Southend on sea. I am sorry, if its long but thats happend

Monday 13 July
We saw the car which had been advertised as in good condition, with a Public Carriage Office licence. The PCO vignette was displayed in the window of the car. However the bodywork was poor with scratches and a dent at the back. We asked for a test drive which you agreed to, however you only let us drive for a very short while. You insisted the car was in good condition, had passed its MOT in July 2009, and was fully roadworthy. During the test drive we noticed that the air conditioning did not work. Because of this and the problems with the bodywork we offered £1,100 not the £1,350, and you accepted the offer on this basis.
Tuesday 14 July
The automatic transmission was not working properly, the car would not change gear and we noticed that the transmission fluid was extremely low. We put 500ml of transmission fluid into the car.
Thursday 16 July
After talking to the PCO Office they advised us that we had to contact the previous owner to get the Certificate back again. We contacted you to ask for the details of the previous owner. Initially you said you did not know who the previous owner was and that we should call you later for details. When we called you said you would contact the previous owner.
Monday 20 July
We contacted you about the PCO Certificate and you said you had the previous owner’s details, and the previous owner was sending the Certificate. It has never arrived.
We were still having problems with the transmission fluid leaking and were putting 500ml of fluid in the car every day.
Monday 27 July
The car would not start. We had a mechanic look at it and he replaced the starter motor and it worked again.
Thursday 30 July
We received a letter from Luton police station, stating that the registration plate is illegal. We called the police, they told us the plate was illegal, because the spaces between the characters was not correct.
We called you, at first you said we should change the number plate ourselves, but we insisted it was not our fault and the car should not have been sold with an illegal number plate. Eventually you agreed to supply a new, legal number plate.
You also said that the PCO Certificate was being sent from Swansea and should arrive within 1 to 2 days.
The car also broke down again: the engine lost all power, stopped completely and would not start again.
Friday 31 July
The problems with the leaking transmission fluid continued, even after regularly topping it up every day the fluid was too low again to make the car safe to drive, even if it had started.
Saturday 1 August
We asked an English colleague to telephone you explain that there were so many problems with this car that we did not consider it roadworthy and fit for purpose. We asked you to take the car back and return our money. You refused but said that we could bring the car to a friend in Walthamstow (65 Hoe Street, Walthamstow, London, E17 4SA) who would look at it with a view to putting it right and it was agreed we could tow the car there on Monday 3 August.
Monday 3 August
We towed the car to the address in Hoe Street, a Skoda garage. We met the person in charge of the garage and gave him a letter (attached) setting out the problems with the car. He said he had no contract with Cricketfield, did not know why you were there, and initially asked me to go to another garage. He then made a telephone call and then agreed to look at the car, but refused to look at the transmission problem.
He said the problem with the car was it did not have enough petrol, however the fuel gauge showed the petrol was low but well above the minimum level. Nevertheless, we put a further 10 litres of petrol in, but the car still would not start.
One of the mechanics looked at the problem with the car not starting, but he could not fix it immediately.
Because the Hoe Street garage would not look at the transmission problem, we called you again, while we were at Hoe Street.
After a while the man in charge at the garage told us we should leave the car with them, they would look at it and call us later.
He then gave me his business card and we saw that his name was also Blackburn and so we assumed that he is your brother or other relative.
Tuesday 4 August
The Skoda garage in Hoe Street called and asked us to collect the car. They advised that the fuel pump needs replacing. They had not carried out any repairs and the car could still not be driven. We had to tow the car home. Mr Blackburn at the Skoda garage said that the fuel pump should work if we hit it.
Conclusion
I think you will agree that a car that has had so many problems in just two weeks and currently will not start and cannot be driven cannot be considered ‘in good condition’ as you described when we bought it. Indeed, it cannot be considered to be roadworthy, and was not roadworthy at the time that we bought it. We therefore feel that the description of the car was misleading and misrepresented and you will be aware that it is illegal to sell a car that is not roadworthy.
We would therefore hope that you will agree in the circumstances to take the car back and refund our money in full.
I look forward to your earliest reply as it is urgent that we have our money back.

Fuelpump being delivered Thursday make arrangements for fitting

Can I confirm we should go back to Hoe street for fitting? Will you be able to fix the transmission at the same time as well?
Is that any news about the PCO Certificate from the previous owner?
Many Thanks

Dear Mr Blackburn
Please could you confirm when I should bring the car in for you to carry out the repairs.
I do need the car urgently, or if you are not able to repair it, to return the car and get my money back.
I look forward to your earliest reply.

need to get the car to Southend call me to make the arrangements
if posible your English friend

Then we are able to change the car for the 1999 model, if we dont need to pay anything. The trailer wich comes today will take the other car?
Thank you!

No of course we cant change the car for one two years newer unless you paid the differance as I told you on the phone. Have you got RAC or AA COVER

Yes, I understand, Then We just want the money back. I have no RAC or AA Cover.
We told you the pump is in stock since last week you asked in previous email if this could be done at Walthamstow and we said it would have to come to Southend we also told you that you shouldn't tow automatics and we would have to pick it up by transport as you know and this was arranged for this evening as you said you would be home please confirm ASAP

Okey, then you can repair the car? That is fine. You can tow it today from the adress in….. You can collect the car at 6 or 7 pm.
And will you able to fix the transmission fluid problem in same time?
How long is that? Can we get any document on this action?
Thanks

You can have a copy of the bills for the pump , we will take a look at your leak

Is there any news on the car, please, as I've not heard anything for a week now and do need this to be sorted urgently?

Monday 28 September 2009
Dear Mr Blackburn

I arranged with you on Sunday (27 September) to collect the car today (Monday) at 10am. We arrived around 12 midday, and we had to wait more than two and a half hours to get it, which meant that I could not work today.

Before I came, you told me the car was repaired, that the transmission specialist had fixed the fluid problem. When we arrived back home in London, we could see the fluid still flowing. I took some photographs which clearly show the fluid flowing from the gearbox.

I called you around 3.30pm and you told me to call back after an hour, but by then you had left the office!

The car has been with you for repair for more than a month, you told me you had checked it and is now working.

I have not been able to use the car since we bought it on Monday 13 July, approximately 2 ½ months ago. Because of that, I have had to hire another car, I have not been able to renew the PCO licensing, as a result I have lost a lot of money.

After all this time I no longer have time to wait for the car to be repaired and I cannot continue to lose more time from work, and therefore yet more money.

I feel there is only one solution and that is for you to take the car back and refund the purchase price of £1,100 in full. In addition I think it is only fair to ask for a contribution towards my lost earnings, phone calls, petrol to and from your garage and your brother’s garage which I estimate to be approximately £600.

If the car is as good as you originally claimed I am sure you will agree that you will have no problem selling it after you have completed the repairs, and as a garage this should not be difficult for you. I cannot, and would not, sell the car in its current condition which I maintain is not fit for purpose and not safe to drive.

I do need an urgent resolution to this problem and I therefore look forward to your agreement to take back the car, and to your immediate payment.

I would not wish to have to involve Trading Standards in this matter but I now feel that this may be the only other option available to me if this cannot be resolved amicably and very quickly.

...And now, no any answer....
