Hi, I'm Sophie, I'm 22 and I'm french and looking for a piece of juridical advices.
My Story :
Begun on the 9 of september when I bought a bed in Ikea edmonton.
I choose my bed, I paid for it and then when I had a bed boxe I realize it must be a problem because it was to small to be my bed, and I asked the lady about it (Fxxxxn Txxxxr). She answered in a contemptuous way. "It was small because it wasn't built yet". I asked a second time and she answerd that's there was only one boxe without even checking for it.
So of course I believed her, because she was a profesional.
Then, I took a taxi, I paid £25 to go in E3.
When I arrived home I tore the box, and I realised, reading the manual, that one box was missing. (guard rails/ladder) . I had only the bed frame, so I can't even build it.
My receip claims that I was supposed to have both :
Article name : Tovik Loft Bd frm / grd rail / l 140x200PI
Qty : 1
Price(GBP) 64.00
Total(GPB) 64.00
Article n°800-645-97
Then I called monday 11 september Ikea to explain the situation. They told : "we are going to delivery you before the end of the week"
Of course they didn't come. I called again they said they were sorry but they couldn't come for some reason. They gave me an appointment for the following monday, so I took a day off to wait for them that day. I called them on the morning that day to be sure that they were coming then they were to arrive by the end of the morning, they didn't come, so called them on the begining of the afternoon, they were sorry again and told that they would arrive at the end of the afternoon. They did'nt come.
I called again and they told "we are sorry, we don't know why, but now it's late for today so maybe tomorrow"
They didn't either come.
And every days somebody was at home to receipt the famous missing part. And almost every day I called Ikea to hear :
"We don't know what's going on"
" You are on the special, special, special list"
"You are the first on our special list of the special list"
"Everything it's gonna be solved"
"Don't worry"
"It's not our fault..."
"We call you as soon as possible" (Never call me back)
After few weeks like this.
At the begining of last week, somebody told me that the post office lost it, so what I was supposed to do ?????? Waiting for a call. (Never call me back again)
So I called back a few days ago, and surprise !!!!
They gave me another reason, showing they were not responsible for what happened. They said the model was defectuous and decided not to sell it anymore.
So they told me in order to have my money back I have to give them the bed they said they were going to pick it up on saturday and one more time they never came.
Actually I bought a bed because I really needed it.
I have no money to buy another one, so I've been sleeping on my matress,on the floor for a month and a half now.
As you surely understand, I'm tired, I've got backache and I'm really angry against Ikea.
So, if, by any chance, you're, somehow, qualified or interested in consumer's law , would you please let me know, asap, what are my rights in such a situation and how can I use them. Should I sue Ikea ? Should I threaten them to do so ? Am I entitled to claim for both the bed's price (£64) AND the bed's delivery's cost (£25) ?
Thank you very much for reading my story and, if possible, for helping me solving this exhausted situation. |
