What to do if scumtree take your money and not post ur ad

Postby scumtree » Fri Mar 28, 2008 9:43 am

Scumtree are good at taking money and not displaying your ad. Their customer service leaves a lot to be desired. They breach ther distance selling regulations which are the rules for sellers to abide by if they sell goods or services by phone or internet

In the first instance, contact your credit card company and dispute the transacion, tell them the company has breached the distance selling regulations in that they have taken the money and not provided the service you have paid for and when contacting them they have done nothing or told you their terms and conditions say they will not refund. The credit card company will mark the item as in dispute and pass a chargeback to gumtree giving them time to suppor their claim to the money. If they dont reply in a certain amount of time the money is paid back automatically.

Then get onto your local trading standards and tell them the same. They will pass it to trading standards near to scumtree who will send an investigator to them. After a certain number of complaints, it will be passed to the office of fair trading who will start an investigation into the company. This scumtree will not like as they will have government invetigators thumbing through their papers and investigating them.

Possibly also the staff at scumtree will be questioned under caution.

dont take crap from scumtree, bring them to rights

saying if you are rude/offensive/ abusive to our staff
you will be whatevered????

If people are polite to me, I reciprocate.

You have a butchers matey, then come back & justify your remarks to that poor bugger(preferably in a manner which makes sense!)

The rest of us don't really have to watch our P's & Q's, since we're not representative of Gumtree, but God only knows how a doughball like you was given the position of moderator.

Please keep it friendly everyone - there is no need to resort to name calling.

When you post an ad on Gumtree it asks you to tick a box to acknowledge that you have read our terms and conditions and posting rules. It is pretty standard for many services that when you breach clearly stated terms and conditions you don't get a refund.

If anyone wishes to complain about a problem with your ads then please contact us through the help pages so that we can help you out.

When Gumtree accept payment for services, they are obliged by LAW to honour the deal, or refund the customers money. Gumtree think they can get away with doing neither of these things.......We'll see how long that is allowed to continue for!

Can you point me to the posting rule/condition which states what you have said above......because I seem unable to find that clause.

Too many unhappy customers posting on here.....I'm glad you don't run the firm I work for, I'd be fearing for my job with feedback as bad as Gumtree's!

I suspect they have a life away from here you know.

And, since you don't appear to actually read anything on here that doesn't suit your views or you don't like, why ask if I am adding anything of value.

You'd ignore it anyway.

The answer was in the thread above, given by the paid staff. Shesh.

PS...Are you saying I like everything I read on here? or are are you just too thick to string a sentence together properly?

So keep your nose out until you know what you're talking about!

*sigh*

Ok. Here we go then.

There is the answer that I refered to above. Given, as I said, by the "paid staff".

Ripdoff wrote: ... When Gumtree accept payment for services, they are obliged by LAW to honour the deal, or refund the customers money. Gumtree think they can get away with doing neither of these things.......We'll see how long that is allowed to continue for!

This is the question to which I was refering.

Here is a link to a paid advert form (just a random one I chose).

http://www.gumtree.com/cgi-bin/add_post ... ing_cat=17

Look for this section and the "tick box" you must complete before the process can be completed:

... I agree to Gumtree's terms and conditions and posting rules ...

You want the posting rules.

http://www.gumtree.com/help/posting_rules

Here is an extract.

... We reserve the right to remove ads without refund where these breach our posting rules and/or terms & conditions. Posters that regularly break our posting rules may find their future use of the site restricted. ...

Here are a few violations that people come on here and admit they did.

... No duplicate ads
We only allow 1 ad for a particular item/ job/ flat etc. Please don't post the same ad (even if re-worded!) more than once either in the same category or across multiple categories ...

... Post on your local Gumtree
Please post on the Gumtree site geographically closest to you. Ads will only be accepted that are geographically specific and locally relevant ...

I think it is rather clear, don't you?

By the way, I think that is a nice example of "justification" if you were looking for it, aka this:

Instead of typing big replies, take yourself down to your local library & read some info on'CONSUMER LAW'....you will quickly come to realise that Gumtree does not dictate the law(although they seem to think they can!)

Until you know what you're talking about, you're best bet is to say nothing!

I can only reply to what you write, not what you think.

Since you wrote about the ToS on here, that is to what I replied. Consumer law, since I am not a lawyer, is another matter. Unless you are, I think I'll take your opinion with a dose of salt, if you don't mind.

Bit rude for a laywer.

Well, if he is a lawyer, he should really do his talking in court, and not on here.

But he is so helpful!!!

he came on, shooting from the lip
and has contributed nowt worthwhile yet
except a tedious line in abuse.

he seemed to get his money back from paypal
and continues to hang around like a bad smell.

still as long as he's enjoying himself.

Why's that then??..........don't you like what I'm saying? Well thats just tough luck!..Freedom of speech & all that eh?

I guess the resident moron-ator is'nt taking me up on the offer he made about his unjustified abuse either.

& yes, I'm having a fuckin' great time...thanks for your concern.

My early posts were about money being taken & nothing received for it....thats where CONSUMER LAW kicks in, so toddle off & try & get your feeble brain to make the link between the two!!

If it helps you feel better, I am not in the slightest trying to curb your free-speech rights. I don't have a "like" or dislike feeling on your posts either -I simply don't care. I'm glad you are having a good time posting on here (although your posts, both in the language and rudeness don't support that, it has to be said).

I however, am simply replying to things that I feel like - in this case, this thread.

You asked a question (not related to Consumer Law in itself), and Admin replied. When you re-asked it, I pointed out that Admin had repiled. When you asked about the ToS reference they had made, I found that for you (and once again corrected you). At no point had you refered to "Consumer Law". Since it is rather an important issue to you, I suggested that you would get a better outcome in court, rather than trading insults with randoms on here. Of course, it's your choice, but at the min, you point remains unproven (since it would appear you have simply got PayPal to solve it for you by default).

Have a nice day now.

Well since you seem to be having great difficultly in understanding why people are pissed off with the service from Gumtree, & their possible courses of action....why don't you just fuck off & stick your useless replies into a posting you can comprehend?
